Terms & Conditions of Use

This English version is a courtesy translation. The legally binding text is the Spanish original, which governs in the event of any discrepancy.

1. Acceptance of the Terms

By accessing and using the website el-sanatorio.com (the “Site”), you agree to be bound by these Terms and Conditions of Use. If you do not agree with any of these terms, please do not use the Site.

2. Service Description

El Sanatorio is a nighttime entertainment venue operating a yakitori gastro bar and an immersive horror experience in Santa Marta, Colombia. The purpose of the Site is to provide information about the venue, manage table and experience bookings, and facilitate contact with our staff.

3. Age Restriction

El Sanatorio serves alcoholic beverages. Alcohol consumption and bar bookings are restricted to people 18 years of age or older, in accordance with Colombian Law 124 of 1994 and Decree 1686 of 2012. Minors are welcome accompanied by an adult until 10:00 p.m.; after 10:00 p.m. entry to the venue is 18+ only. By using the booking form, you declare that you are 18 or older.

The immersive horror experience (“El Laberinto”) follows the same time-based rule: accompanied minors until 10:00 p.m., and 18+ only after that.

4. Permitted Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. The following are expressly prohibited:

• Making fraudulent or bad-faith bookings.
• Using the Site for illegal activities or to infringe the rights of third parties.
• Attempting to access the operator’s systems or databases without authorisation.
• Reproducing, distributing or modifying the content of the Site without written authorisation.
• Transmitting viruses, malware or malicious code of any kind.

5. Bookings and Cancellations

Bookings made through the web form are provisional until confirmed by El Sanatorio staff. The venue reserves the right to refuse or cancel bookings without giving reasons.

Customer cancellations must be communicated at least 24 hours before the booked time, via WhatsApp to +1 903 459 8763. Repeated no-shows on confirmed bookings may result in the user being barred from using the online booking service.

For table and Maze bookings, the 50% deposit is refundable if the customer cancels at least 24 hours before the booked time. If El Sanatorio cancels the booking, the deposit is refunded 100%.

Private events are governed by a separate, tiered cancellation schedule based on how much notice is given. That schedule is published on the private events page and forms part of these terms for that type of booking.

6. Intellectual Property

All Site content, including texts, images, logos, designs, source code and the creative concept of “El Sanatorio,” is owned by or licensed to EL SANATORIO S.A.S. and is protected by Colombian and international intellectual-property laws. Total or partial reproduction without written authorisation is prohibited.

7. Limitation of Liability

EL SANATORIO S.A.S. shall not be liable for:

• Damages arising from the use or inability to use the Site.
• Site interruptions, errors or technical faults.
• Content of third-party websites linked from the Site.
• Data loss arising from information-transmission failures.

The immersive horror experience involves dark environments, intense sound effects and live performances. EL SANATORIO S.A.S. is not responsible for adverse reactions arising from the experience in persons with pre-existing medical conditions. We recommend consulting with staff before participating if you have any relevant health condition.

8. Privacy and Personal Data

The processing of your personal data is governed by our Privacy and Personal-Data Processing Policy, available at el-sanatorio.com/en/privacy, in accordance with Colombian Law 1581 of 2012.

9. Modifications

EL SANATORIO S.A.S. reserves the right to modify these Terms at any time. Amendments take effect from the moment they are published on the Site. Continued use of the Site following the publication of amendments constitutes acceptance of them.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Colombia. For any dispute arising out of the use of the Site, the parties submit to the jurisdiction of the courts and tribunals of the city of Santa Marta, Magdalena, Colombia, waiving any other jurisdiction that might otherwise apply.

12. SMS / WhatsApp Messaging (A2P Program)

If you provide your mobile phone number when booking or contacting us, you may receive messages from EL SANATORIO S.A.S. via WhatsApp and/or SMS regarding your booking, your deposit and opening updates. By providing your number and giving your consent, you expressly authorise these messages.

• Mobile phone numbers we collect for messaging are not shared or sold to third parties for marketing purposes. They are used solely to contact you about your booking, your deposit and the opening.
• Message frequency may vary.
• Message and data rates may apply, depending on your carrier and plan.
• To stop receiving messages, reply STOP to opt out; for help, reply HELP. You can also reach us on WhatsApp at +1 903 459 8763.

This messaging consent is additional to the data-processing authorisation described in our Privacy Policy (Law 1581 of 2012), and you may withdraw it at any time without affecting other services.
